David B. Madoff represents individuals, small businesses and large corporations experiencing financial distress. He has served since 1997 on the panel of Chapter 7 trustees for the District of Massachusetts, Eastern Division. As trustee and as counsel to debtors, he is involved in more than 750 bankruptcy cases each year.
He previously practiced with the New York law firm of Hughes Hubbard & Reed and was a partner of Cohn Khoury Madoff & Whitesell LLP in Boston.
Mr. Madoff has lectured and written articles for Massachusetts Continuing Legal Education and other associations on bankruptcy and bankruptcy litigation. He has appeared as a guest on FOX 25 News and has been quoted in bankruptcy-related articles in The New York Times, The Boston Globe, the Boston Herald and The Providence Journal.

Selected decisions
- Healthco Int’l v. Repco Printers, 1st Cir. 1997. Counsel to the trustee. A $235,000 pre-bankruptcy payment was held outside the ordinary course defense to a preference claim.
- Hicks, Muse & Co. v. Brandt, 1st Cir. 1998. Counsel to the trustee. The court affirmed approval of the trustee’s $45 million settlement with the bank group.
- In re Malden Mills Industries, 281 B.R. 493 (Bankr. D. Mass. 2002). Counsel to the Official Committee of Unsecured Creditors in the Malden Mills Chapter 11.
- Zacharakis v. Melo, 558 B.R. 521 (Bankr. D. Mass. 2016). Counsel to the debtor. The court rejected a creditor’s bid to exempt $268,000 in claims from discharge.
- Agin v. Cusson, 557 B.R. 15 (Bankr. D. Mass. 2016). Counsel to the debtor. The court denied an objection to discharge and preserved the debtor’s fresh start.
- Eastern Bank v. Benton, 563 B.R. 113 (Bankr. D. Mass. 2017). As trustee, avoided a defective mortgage for the benefit of unsecured creditors.

Board service
Mr. Madoff serves as Chairman of the Board of Directors of Family and Community Resources, Inc. (FCR), a Brockton nonprofit that serves individuals and families affected by trauma, including domestic and community violence.
